1. PURPOSE OF THIS POLICY
This policy explains how Lay Your Layer may use payment verification, liveness checks, camera checks, microphone checks, cardholder-authority checks, age checks, fraud-prevention checks, export controls, Store controls, Layer Credit controls, and loss-prevention checks before or after payment.
Lay Your Layer provides bespoke digital personalisation-layer subscriptions, AI services, Coding Layer services, Voice services, Store access, Layer Credits, creator products, downloads, exports, personalisation tools, and other digital services.
Because Lay Your Layer may supply digital access, personalisation, Store access, downloads, exports, Layer Credits, creator products, and AI services immediately, Lay Your Layer may require verification before allowing payment, Store access, downloads, exports, or other high-risk digital delivery.
Nothing in this policy removes rights that cannot legally be removed.
2. NO SECRET CAMERA OR MICROPHONE USE
Lay Your Layer will not intentionally activate a user’s camera or microphone secretly.
Camera or microphone access will only be used where:
the user is clearly told;
the user gives the required device permission;
the user gives the required verification consent or agreement;
the check is reasonably needed for payment security, loss prevention, fraud prevention, age verification, cardholder-authority verification, Store access, Layer Credit access, creator product access, download access, export access, or dispute protection.
Camera and microphone checks must not be hidden from the user.
3. REQUIRED VERIFICATION BEFORE PAYMENT
Lay Your Layer may require users to complete verification before payment is accepted or before digital access is supplied.
Verification may be required for:
all paid subscriptions;
Store access;
Layer Credit purchases;
Store Credit purchases;
AI Core access;
Coding Layer access;
Voice system access;
creator products;
downloads;
exports;
large upfront payments;
prepaid subscriptions;
high-risk payments;
first-time payments;
suspicious payments;
payments with mismatched details;
payments involving child-risk concerns;
payments involving cardholder-authority concerns;
payments where fraud risk is detected.
If the user refuses required verification, Lay Your Layer may refuse the transaction, delay access, block Store access, block Layer Credits, block downloads, block exports, freeze the account, cancel the order, or require another lawful verification method.
4. LIVENESS CHECKS
Lay Your Layer may require a liveness check to help confirm that the user is a real person and not an automated system, bot, fake AI system, stolen identity, replay attack, or fraudulent user.
A liveness check may include:
live selfie;
short live video;
turning the head;
blinking;
looking left and right;
raising a hand;
scratching the nose;
touching the ear;
speaking a displayed phrase;
reading a random number;
answering a payment-authority question;
confirming the cardholder-authority statement.
The liveness action may change each time so it cannot easily be replayed.
5. SPOKEN PAYMENT AUTHORITY PHRASE
Lay Your Layer may ask the user to say a short phrase before payment or before export.
Example phrase:
“I am [full name]. I am authorised to use this payment method. I am requesting immediate access to my Lay Your Layer bespoke digital personalisation-layer subscription. I understand this digital access may begin immediately and is non-refundable once supplied, except where the law requires otherwise.”
Lay Your Layer may record the spoken phrase where the user has clearly agreed and where the recording is reasonably needed for fraud prevention, payment security, dispute evidence, or loss prevention.
6. FACE AND IDENTITY CHECKS
Lay Your Layer may require a live face check where reasonably needed for payment security, Store access, Layer Credits, creator products, downloads, exports, or fraud prevention.
If Lay Your Layer uses facial recognition, biometric recognition, voice recognition, or other biometric verification to identify or verify a person, Lay Your Layer should obtain the required explicit consent or other valid lawful basis and special-category condition before processing that data.
Lay Your Layer may use a trusted third-party identity, liveness, age-assurance, fraud-prevention, or payment-verification provider.
Third-party verification providers may have their own privacy terms.
7. PAYMENT SECURITY AND 3D SECURE
Lay Your Layer may require Strong Customer Authentication, 3D Secure, bank-app approval, one-time passcode approval, payment-provider fraud checks, or other payment security checks before accepting payment or supplying access.
A payment passing one security check does not guarantee that Lay Your Layer must provide instant export, instant download, Store access, Layer Credits, or unrestricted account access.
Lay Your Layer may still delay or block access where fraud risk remains.
8. PAYMENT METHOD AUTHORITY
Users must only use payment methods they are authorised to use.
Users must not use:
stolen cards;
another person’s card without permission;
a parent’s card without permission;
a guardian’s card without permission;
a partner’s card without permission;
a business card without authority;
a PayPal account without authority;
an Apple Pay account without authority;
a Google Pay account without authority;
a bank account without authority;
a payment wallet without authority;
a payment method obtained through fraud;
a payment method connected to identity misuse;
a payment method they know may be disputed as unauthorised.
By paying, the user confirms they are authorised to use the payment method.
9. AGE AND CARDHOLDER CONFIRMATION
Before payment, the user may be required to confirm:
I am 18 or over, or I have permission from the payment method owner and any required parent or legal guardian.
I am authorised to use this payment method.
I understand that using someone else’s payment method without permission may be unlawful.
I understand that if I use a payment method without authority, Lay Your Layer may suspend access, preserve evidence, report suspected fraud, and seek recovery of losses from the responsible person where lawful.
10. IMMEDIATE DIGITAL ACCESS CONFIRMATION
Before payment, the user must agree:
I request immediate access to my Lay Your Layer bespoke digital personalisation-layer subscription, Store access, Layer Credits, digital product, creator product, voice product, download, export, or other selected digital service.
I understand that Lay Your Layer may begin being supplied, configured, shaped, trained, adapted, accessed, downloaded, exported, or personalised immediately.
I understand that once immediate digital access begins, I lose any cancellation right that would otherwise apply to that immediate digital supply, except where the law requires otherwise.
I understand that charges are non-refundable once supplied, except where the law requires otherwise.
I understand that I can cancel future subscription billing at any time.
I agree to continue.
11. NO REFUNDS AFTER DIGITAL SUPPLY
Lay Your Layer is a bespoke digital personalisation-layer service.
Once immediate digital access, Store access, Layer Credits, downloads, exports, creator products, AI Core, Coding Layer, Voice system, personalisation tools, training tools, or other digital services are supplied, charges are non-refundable except where the law requires otherwise.
This is because the user may receive immediate value through digital access, personalisation, training opportunity, Store visibility, Layer Credits, downloads, exports, creator products, AI replies, system access, or bespoke layer configuration.
12. EXPORT CONTROL
Lay Your Layer may delay export until verification is complete.
Lay Your Layer may block export where:
payment verification is incomplete;
camera/liveness verification is incomplete;
microphone verification is incomplete where required;
3D Secure or SCA is incomplete;
the payment is high-risk;
the payment is under fraud review;
the payment is disputed;
the payment is reversed;
the payment is charged back;
the payment appears unauthorised;
the user is underage or authority is unclear;
the user refuses verification;
there is an unpaid balance;
there is a breach of Terms;
there is suspected Store abuse;
there is suspected Layer Credit abuse;
there is suspected creator abuse.
Full export is not guaranteed immediately after payment.
Full export may require payment clearance, verification clearance, account good standing, and completion of the required payment path.
13. DOWNLOAD CONTROL
Lay Your Layer may delay downloads until verification is complete.
If a download is supplied immediately after verification and payment, the purchase is non-refundable once supplied, except where the law requires otherwise.
If a payment is later reversed, charged back, disputed, or found unauthorised, Lay Your Layer may remove access, disable downloads where possible, suspend the account, preserve evidence, and seek recovery from the responsible person where lawful.
14. STORE ACCESS CONTROL
Lay Your Layer may require verification before Store access.
Store access may be blocked where:
the user refuses required verification;
payment authority is unclear;
the user is underage;
fraud risk is detected;
payment is disputed;
payment is reversed;
payment is charged back;
there is an unpaid balance;
there is suspected Store abuse;
there is suspected Layer Credit abuse;
there is suspected creator abuse.
15. LAYER CREDITS AND STORE CREDIT
Layer Credits and Store Credit are closed-platform digital credits for eligible Lay Your Layer in-platform purchases only.
They are not cash, cryptocurrency, a bank account, an investment, or external money.
Layer Credits and Store Credit cannot be withdrawn as cash, transferred outside Lay Your Layer, or resold unless Lay Your Layer allows it in writing.
Layer Credit and Store Credit purchases are non-refundable once supplied, except where the law requires otherwise.
Lay Your Layer may require camera, liveness, microphone, identity, age, cardholder-authority, payment-authority, SCA, or 3D Secure checks before supplying Layer Credits or Store Credit.
16. REFUSAL OF VERIFICATION
If a user refuses a required verification check, Lay Your Layer may:
refuse the payment;
cancel the order;
delay digital access;
block Store access;
block Layer Credits;
block downloads;
block exports;
block creator purchases;
freeze the account;
require another lawful verification method;
limit access to support only.
Refusing verification does not give the user a right to receive digital access without verification.
17. DATA MINIMISATION
Lay Your Layer should collect only what is reasonably needed for payment security, fraud prevention, loss prevention, cardholder-authority verification, age verification, Store protection, Layer Credit protection, creator protection, export protection, download protection, dispute defence, or legal protection.
Lay Your Layer should not collect more camera, microphone, identity, face, voice, or liveness data than reasonably needed.
18. VERIFICATION DATA USE
Verification data may be used to:
confirm the user is real;
confirm liveness;
confirm payment authority;
confirm cardholder permission;
confirm age;
prevent fraud;
prevent child payment misuse;
prevent stolen card use;
prevent chargeback abuse;
protect Store access;
protect Layer Credits;
protect creator payouts;
protect downloads;
protect exports;
respond to payment disputes;
respond to chargebacks;
recover losses where lawful;
protect Lay Your Layer.
Verification data must not be used for unrelated marketing.
Verification data must not be sold.
Verification data must not be used for general AI training unless the user has separately and clearly agreed where lawful.
19. VERIFICATION RECORDS
Lay Your Layer may keep verification records where reasonably needed for payment security, fraud prevention, loss prevention, chargeback defence, Store protection, Layer Credit protection, export protection, creator protection, legal claims, audit, and compliance.
Verification records may include:
verification consent record;
device-permission record;
camera-permission record;
microphone-permission record;
liveness result;
short video verification result;
selfie verification result;
voice phrase result;
spoken phrase confirmation;
age confirmation;
cardholder-authority confirmation;
payment-authority confirmation;
time and date;
order number;
payment reference;
account email;
session ID;
IP address;
device information;
browser information;
fraud review result;
manual review notes;
verification outcome.
20. RETENTION OF VERIFICATION DATA
Lay Your Layer may retain verification data only for as long as reasonably needed for payment security, fraud prevention, dispute defence, chargeback defence, unauthorised-payment claims, legal claims, audit, compliance, Store protection, Layer Credit protection, creator protection, export protection, or record-keeping obligations.
Where verification data is no longer reasonably needed, Lay Your Layer should delete, minimise, restrict, anonymise, or archive it where appropriate.
21. PAYMENT DISPUTES AFTER VERIFICATION
If a payment is later disputed, reversed, charged back, refunded by a payment provider, or reported as unauthorised, Lay Your Layer may:
suspend the account;
freeze the account;
remove paid access;
remove Store access;
remove Layer Credits;
remove creator products;
remove downloads where possible;
remove export access;
remove voice products;
remove coding access;
remove AI Core access;
pause personalisation;
pause layer training;
block further purchases;
preserve evidence;
respond to the payment provider;
report suspected fraud where appropriate;
seek recovery from the responsible person where lawful.
22. RECOVERY OF LOSSES
Where Lay Your Layer suffers loss because a person used a payment method without authority, made a false payment-authority statement, committed payment fraud, caused a chargeback, abused a dispute process, or received digital access before a payment was reversed, Lay Your Layer reserves the right to recover losses from the responsible person where lawful.
Recoverable losses may include:
the original payment amount;
chargeback fees;
payment provider fees;
bank fees;
admin costs where recoverable;
legal costs where recoverable;
debt recovery costs where recoverable;
fraud investigation costs where recoverable;
Store losses;
creator payout losses;
Layer Credit losses;
export losses;
download losses;
digital service access value;
loss caused by unauthorised access;
loss caused by false statements;
loss caused by fraudulent conduct;
loss caused by breach of Terms.
23. CHILD PAYMENT MISUSE
Users under 18 must not purchase paid access, Store access, Layer Credits, creator products, voice products, exports, downloads, or subscriptions unless Lay Your Layer clearly allows guardian-approved use.
If a child uses an adult’s payment method without permission, Lay Your Layer may suspend the account, remove access, preserve evidence, respond to the payment provider, and seek recovery from the responsible person where lawful.
If a bank, card issuer, payment provider, court, regulator, or applicable law requires a payment reversal, Lay Your Layer will follow the required process.

25. RANDOM LIVENESS INSTRUCTION WORDING
During verification, Lay Your Layer may show one or more random instructions such as:
Please look into the camera and say the phrase shown on screen.
Please scratch your nose.
Please turn your head left, then right.
Please blink twice.
Please raise your hand.
Please say: “I am authorised to use this payment method.”
Please say: “I request immediate Lay Your Layer digital access.”
Please say the random number shown on screen.
These checks help confirm that the user is present, live, authorised, and not using a fake replay, bot, stolen account, or unauthorised payment method.
26. NO WAIVER OF MANDATORY RIGHTS
Users may agree to immediate digital access and may lose cancellation rights connected to that immediate digital supply where lawful.
However, nothing in this policy removes rights that cannot legally be removed.
This includes rights that may apply to unauthorised payments, faulty digital content, misdescribed services, failed supply, fraud, or other mandatory legal protections.
